Paver Cleaning & Sealing Addendum

This addendum applies when the service agreement includes paver cleaning, joint sand replacement, or sealing. It supplements the Apex Hydro Wash LLC Service Terms and Conditions. If the two conflict on paver work, this addendum controls.

Read the general Service Terms & Conditions together with this addendum.

1. Scope of Paver Services

Paver work includes only the steps listed in the scope of the agreement, which may include cleaning, stain treatment, joint sanding, and sealer application. Additional work requested will be added in writing and will carry an additional charge.

2. Surface Condition and Pre-Existing Issues

Apex is not responsible for pre-existing conditions, including:

  • Cracked, chipped, broken, sunken, heaved, or uneven pavers
  • A failing or poorly compacted base, drainage issues, or settling
  • Prior sealers, coatings, or treatments of unknown type that may react with new products
  • Efflorescence (white mineral deposits) or moisture trapped in the pavers
  • Color variation, staining, or wear that exists in the pavers or develops from their manufacture or age

Cleaning may reveal existing damage or inconsistencies that were hidden by dirt or growth. Apex will be held harmless by the customer for all preexisting or post-existing paver issues due to any of the above issues.

3. Cleaning Results

Cleaning removes most surface dirt, algae, mildew, and all other organics. Stains may be permanent. This includes rust, oil, grease, fertilizer, tannin, paint, and deeply set discoloration. Apex does not guarantee complete removal of any stain. Where pressure washing is needed to clean pavers, higher pressure can loosen joint sand or slightly change the surface texture. The Customer accepts that risk when this is included in the scope of work. Paver staining is available for an additional charge.

4. Joint Sand

Cleaning and sealing may remove or displace joint sand. If replacement is included, Apex will add sand to the joints, which may continually settle over time. Some sand loss, shifting, and resettling is normal, especially after rain. Polymeric or stabilizing sand may take time to cure and may haze if wet during curing. Apex does not guarantee against joint erosion, weeds, or insects.

5. Sealer Selection and Appearance

The Customer has chosen the sealer type and finish shown on the front of the agreement (for example, natural or matte, satin, or wet-look, and any color enhancing or tinted product). Sealers change the appearance of pavers, typically darkening or enhancing color. Final appearance varies with the paver material, age, porosity, and prior treatments. Apex will apply the product as directed by the manufacturer but cannot guarantee a specific shade, sheen, or match to a sample. “Grip” textures are highly recommended in wet areas such as pool decks or hot tub areas. Test areas are available on request and, if declined, the Customer accepts the results.

6. Application Conditions

Sealer needs suitable weather and a fully dry surface. Apex may postpone work for rain, high humidity, dew, wind, extreme heat or cold, or moisture in the pavers. Once applied, sealer needs time to cure (24-hour minimum, and 48 hours are recommended). Rain, irrigation, sprinklers, or moisture during that period can cause cloudiness, whitening, bubbling, or uneven finish. The Customer agrees to:

  • Turn off sprinklers and keep water away from the area until the manufacturer’s recommended cure time is complete
  • Keep vehicles, pets, foot traffic, furniture, and debris off the pavers for the manufacturer’s recommended cure time
  • Remove or protect items on the surface before service to avoid additional fees

Apex is not responsible for damage or defects caused by moisture, traffic, or contamination during the manufacturer’s recommended curing period.

7. Trapped Moisture and Hazing

Sealing over damp pavers or pavers with moisture rising from below can cause a milky or white haze. Because moisture in the base or from irrigation is outside Apex's control, Apex is not responsible for hazing that results from moisture trapped in the pavers or from site drainage. In the unlikely event this occurs, Apex may recommend corrective steps. Please contact your Apex representative within 24 hours.

8. Slip Resistance

Sealed surfaces, especially glossy or wet-look finishes, will become slippery when wet. Apex does not guarantee a slip-resistance rating. If added traction is wanted, ask for an anti-slip additive before service, which may cost extra. The Customer is responsible for using the surface safely. Customer will hold harmless Apex from any slip and fall or any accidents due to the reduction in friction on any area of application.

9. Sealer Performance and Maintenance

Sealer wears with sun, weather, foot and vehicle traffic, chemicals, and time. Manufacturer durability estimates are not guarantees, and Apex does not warrant a specific lifespan. Regular cleaning and periodic resealing are normal maintenance. Apex is not responsible for wear, peeling, or discoloration caused by:

  • Vehicle traffic, tire marks, moving of furniture, or heavy loads
  • Lawn chemicals, pool chemicals, de-icers, abrasive materials, or harsh cleaners
  • Pool or spa water, standing water, or poor drainage
  • Cleaning or maintenance

10. Surrounding Areas and Overspray

Apex will take reasonable care to mask and protect nearby surfaces. Sealer msy drift or splash onto walls, windows, pool decks, landscaping, and vehicles. The Customer agrees to move or protect items in the area beforehand. Apex is not responsible for sealer on items left in the work area or on surfaces left unprotected. Apex will make reasonable efforts to remove accidental overspray promptly when reported at the time of service.

11. Pools, Fountains, and Drains

Cleaning products and sealers should not enter pools, drains, or storm systems. Apex will take reasonable precautions for prevention, and is not responsible for water chemistry changes or cleanup costs from runoff if the Customer did not disclose the need for special considerations prior to the proposal acceptance.

12. Inspection and Notice of Problems

The Customer should inspect the work at completion. Any concern about the finish, coverage, or appearance must be reported to Apex in writing within 7 days of service for review while conditions are unchanged. Property damage claims are handled under the main terms, with written notice within 30 days.

13. Warranty and Limitation of Liability

Apex provides a 1-Year workmanship warranty for all paver sealing projects.

Except as stated in a standard workmanship warranty, and to the fullest extent allowed by law:

  • Apex makes no other express or implied warranties about paver work or sealer performance.
  • Apex's total liability for any claim relating to paver services is limited to the amount the Customer paid for the paver services in question, or to the cost of re-doing the affected work, at Apex's choice.
  • Apex is not liable for indirect, incidental, or consequential damages, such as loss of use or lost rent.

These limits do not apply to liability that cannot legally be limited, such as for gross negligence or willful misconduct.

14. Customer Acknowledgment

By signing the agreement, the Customer confirms they have read this addendum, understand the limits described above, and have disclosed any known issues with the pavers, prior sealers, drainage, or underground utilities and irrigation.
